A person can disappear from the photo roster after release, transfer, sentence completion, or a report update. The county did not publish a precise rule such as a fixed number of hours after release.

Wadena County Mugshot Law

Minnesota law is direct about booking photographs. Minn. Stat. 13.82, subd. 26 defines a booking photograph as a photo or electronic image taken by law enforcement for identification in connection with an arrest. The same subdivision says a booking photograph is public data unless another rule applies. It also allows a law-enforcement agency to temporarily withhold access when release would adversely affect an active investigation.

Key Statutes:

Minn. Stat. 13.82 covers law-enforcement data, including booking-photo public-data language and investigation-based limits.

Minn. Stat. 13.03 presumes government data are public for inspection and copying unless a law classifies them otherwise.

Minn. Stat. 13.85 classifies some corrections and detention data when disclosure would create safety, investigation, informant, or facility-security risks.

Those laws explain both sides of the Wadena County mugshot process. A current booking photo can be public, yet a specific photo or related record may still be withheld or limited if the sheriff determines that public access would harm an active investigation or if another data classification applies.

Why Mugshots May Be Missing

Mugshots and Court Records

Wadena County jail mugshots are booking records. They are not the same thing as court records, and they do not prove conviction. After an arrest, the jail report may show the booking charge, while the Wadena County Attorney decides what formal charges to file in court. The Minnesota Court Records Online portal can show case events and public documents, but it is not a mugshot database.
